How to calculate death and disability compensations resulted from work injuries
First: In case the injury of the worker led to his death:
In this case, his family members are entitled to compensation equivalent to the basic wage of the worker for a period of 24 months, Provided that the value of the compensation shall not be less than eighteen thousand dirhams and not more than thirty five thousand dirhams and the value of the compensation shall be calculated on the basis of the last wage paid by the worker prior to his death.
If the last salary the worker received before he was injured is 1,000 dirhams, the death allowance his family deserves is 24,000. If his last salary was 2000 dirhams, the death compensation would not be 48,000 dirhams, but 35,000 dirhams, And also if the last salary was seized is 500 dirhams, the compensation is not 12000 dirhams but 18000 dirhams as the amount of compensation is limited between the values of 18000 dirhams minimum and 35,000 dirhams maximum. (Article 149)
Second: In case the injury of the worker led to total disability:
In the sense that the worker has become permanently incapable of practicing any profession or work that he earns his living from, and it is confirmed by a decision of the competent medical committee after the stability of his situation, Such as total loss of sight, loss of arms, loss of legs, mental illness, or chronic and intractable diseases.
The amount of compensation due to the worker in case of total permanent disability is the same amount due in case of death, which is equal to the basic wage of the worker, For a period of twenty-four months, provided that the value of the compensation is not less than eighteen thousand dirhams and not more than thirty five thousand dirhams, (Article 151).
Thirdly: If the worker’s injury leads to partial disability:
In other words, the worker is permanently incapacitated from performing his work. The partial disability, although it reduces the worker’s ability to produce and earn a certain percentage, (is the rate of disability) , but does not prevent the worker from performing his work entirely.
In this case, the injured worker is entitled to compensation in accordance with the percentages specified in the tables attached to the Labor Law multiplied by the amount of the death compensation, (Article 150).
If the injury of the worker, for example, causes him to lose his full elbow, the percentage of disability according to the schedule of the Labor Law is 70%. If the last monthly salary that was collected before the injury is 1000 dirham, The compensation due to the worker in this example is 16800 dirhams . Because the death compensation in this example is 24,000 dirhams.
In another example, if the injury leads to loss of one eye, the disability rate is 45%. The salary of the worker whose last monthly salary was 1500 dirhams is 16,200, because the death compensation in this case is not 36000 but 35000, and the sum of 35,000 is 45%. 16200.
Thus, we have shown how to calculate death compensation and compensation for both total disability and permanent partial disability based on the UAE Labor Law.
