According to the UAE medical liability act No.4 of 2016
Minor injuries that require simple treatment may turn into serious injuries if accompanied by a medical malpractice ,which is caused by the lack of adequate medical expertise of the doctor ,nurse, medical staff or their assistants ,which means that the medical authorities deviate from the medical duties imposed on them ,when a medical malpractice occurs the concerned parties are entitled to file a complaint and claim their patient’s right , and that is mentioned in article (24) of the medical liability act which states :
“ The concerned parties may lodge medical malpractice related complaints with the public prosecution, and the latter shall refer such complaints immediately to the competent health body to take actions as set forth in this decree “.
The medical liability act gave the patient’s relatives the right to file a complaint to the public prosecutor, after confirming that there was a medical malpractice, which in turn refers it to the competent health authority which sets up its medical report which ensures that the medical staff are charged with medical malpractice, and at this point they are investigated as stated in article (24):
“In all cases, practitioners may not be investigated, nor may they be arrested or placed in preventive confinement due to a complaint against them unless the final medical report is provided by the health body stating existence of the gross medical error committed by the defendant”.
The medical malpractice was serious in its ability to turn a patient with simple illness to a patient with a serious illness and may reach the death limit, so it was natural for those who were damaged by a medical malpractice to have their legal channel to report their complaint and recover the right which reserved by law .
