In accordance with UAE law of medical liability no.6 of 2016 and its amendments
The medical profession is a moral and humanitarian profession rather than commercial , this profession has been known since ancient times ,in Greece, famous doctor – Hippocrates – who is considered the father of doctors and the father of medicine was famous for his oath ,which is taken by every doctor before practicing the profession and it’s called – Hippocrates oath – because he drew all his possibilities in the development of this humanitarian profession , and the doctor is the only person who can heal people and relief them from their aches and pain by being able to identify the disease and the right medicine for it .
However, despite all the professional ethics they have the doctors may sometimes make mistakes, and this situation is punishable by law as article – 6 – of the medical liability act states :
A medical error is an error committed by practitioner due to any of the following reasons :
1. Ignorance in the technical matters that are supposed to be known by any practitioner of the same degree and specialization .
2. Non-compliance with the recognized professional and medical principles .
3. Not exercising due diligence .
4. Negligence and not paying attention .
Criteria of gross medical error shall be set out in the implementing regulations of this decree .
We note from the above that the medical error is a mistake committed in the medical field ,as a result of lack of experience or efficiency by practicing physicians or auxiliary groups , or as a result of practicing a modern and experimental process in treatment, or as result of an emergency requiring speed at the expense of accuracy or as result of the complex nature of the treatment .This error is one of the biggest and most important mistakes that are made against human beings because it can often take his life .
