The invalidity of gambling and betting in accordance with the UAE Civil Code
Gambling is defined as a contract between two gamblers, in which each gambler undertakes to pay (if he loses the gamble) to the gambler who win the gambling a sum of money or anything else agreed upon, but betting is a contract under which the bettors undertake themselves to pay – if they were not right in a specific incident or situation- for the person who was true a sum of money or anything else agreed upon.
The right of the contractor in both gambling and betting depends on an unrealized fact, which is winning the gambler in the gambling or the bettor was true in the betting, as for the invalidity of both gambling and betting is due to the first paragraph of Article 739 of the UAE Civil Code, which provides that:
Any agreement relating to gambling or betting shall be null and void.
The gambling moral offence annulled its contract absolutely null, as same as betting because the person who headed to either each of them seek to be easily wealthy without any effort, consequently gambling and betting are contrary to the public order, as gambling has harmful impact on gamblers’ families which make their stability unstable, moreover the gambler neglected his family therefore threaten their security and future.
On the other hand, gambling games and betting do not produce money and do not have constitute value. The results of gambling games are limited to the circulation of money between gamblers, therefore depriving the society from profits of those funds if it didn’t harness in productive work that increases the country’s wealth and employs a workforce in it, consequently gambling and betting have harmful effect on economic growth rate in countries that gambling and betting are thriving in it.
However, the law, if it forgets the good in some forms of gambling or betting, made it legal in some games as he did when he allowed in some sports and permitted the winner to earn some money to encourage these useful games, and to give to the players some motivation to win, and as he did when he allowed a share to charities, as to provide them with payoff of money to spent in charity.
