Establishment of Reconciliation and Settlement Centers – Lawyer Dubai Abu Dhabi

Establishment of Reconciliation and Settlement Centers
For the Commercial and Civil Disputes, and their Tasks

The Federal law, of establishing reconciliation and settlement centers for the commercial and civil disputes, aims at settling the dispute amicably and replacing it with reconciliation among its parties before filing a case before judiciary. In addition to this, the legislator aims, through this law, to instill the spirit of brotherhood among people and to encourage them to resolve the conflicts arising between them amicably instead of controversy and dispute at courts, in addition to importance of this system in investing time and reducing efforts and expenses.
For how to establish a reconciliation and settlement center, this has been determined in the second article of the Federal Law number 17 of 2016 which states that:
1- The Minister or the head of the local judicial authority may establish one reconciliation and settlement center or more within the jurisdiction of the courts of first instance.
2- The Minister or the head of the local judicial authority may issue the regulations governing work of the reconciliation and settlement center, provided it includes the territorial jurisdiction for each center, in case of more than one center, in the court of first instance jurisdiction.
For type of commercial and civil disputes these centers are authorized to settle, Article 3 of the law has determined tasks of the center as follows:
1- The centers are competent in resolving the commercial and civil disputes with known value, that do not exceed (500000) five hundred thousand dirham.
2- The litigants may agree to resort to the centers in the following cases:
A- Reconciliation in commercial and civil disputes with known value, exceeds (500000) five hundred thousand dirham.
B- Reconciliation in commercial and civil disputes with non-estimated value.
The disputes not included in the centers’ tasks are determined in Article 4 which states:
The following are not included in the centers’ tasks:
1- Urgent and temporary orders and claims.
2- Cases in which the government is a party.
3- Lease claims heard before the rental dispute committees.
4- Labor lawsuits.
5- Personal status cases.
6- Any other claims to be heard before another center, committee or authority with a similar competence.
Thus, and in accordance with Articles of the law which determine establishment of reconciliation and settlement centers and their tasks, we can say they give an important support to courts, and this helps relieve the pressure, and on the other hand they develop communication among members of the society in order to resolve their disputes in amicable ways which ensure that everyone has his right.
