Sexual transformation legal perspective according to medical liability law no.4 of 2016 and its amendments
Some people suffers from sexual disorder specially the young people, in more accurate words, the inability to determine sexual identity, wherein they feel that they belong to the other gender completely or partially, so they resort to gender reassignment surgery or as known as gender correction, as the secondary sexual characteristics change to match their real gender psychologically.
We must distinguish between two cases. The first one is the psychological and behavioral disorder that drive the person to sexual transformation. And the people that need psychological treatment and evaluating their behavior. The second one is the case when the male created in a female’s body or a female in male’s body or the one who have the sexual male and female characteristics together, and these people who need to the sexual correction operation as they are the victims of hormonal disorders that leads to the inability to identify their sexual identity.
the gender reassignment surgery requires defining the gender before anything else. Which occurs by medical tests and laboratory diagnostic .and when they ascertain that the sexual correction is necessary, the person could immediately correct his gender, and that requires the exchange of his gender in the legal terms., and the UAE law allows the sexual correction operations, but this is conditional on the existence of a case that deserves the operation. the medical liability law stated disciplines on the sexual correction operation, as article 7 provided that:
sex correction operations may be made according to the following controls:
1. The person’s gender is obscure and it is not certain whether he is male or female.
2. The person has sexual and physical features inconsistent with his/her physiological, biological and genetic characteristics.
3. The provision of paragraphs (1 and 2) of this article is proven by medical reports and approval of specialized medical reports and approval of specialized medical committed formed by the health body with the aim of defining the patient’s gender and approving the correction operation, the said committee shall refer the subject to the psychologist to make necessary psychological preparation.
The sexual correction operation don’t conduct in messy way and are not subject to whom intended to submitted to it , but this operation is to treat the people who suffering from the of hormonal disorders that lead to their birth in bodies that not for them , so the medical education of these operations and the clarification to the public that this operation is a treatment for the people who suffers from hormonal disorder is necessary ,most people in our societies still consider sexual transformation is repulsive and stay away from transgender person. so Sexual transformation firstly and finally is a disease that affects the person like any other disease., and he needs support from his family and his surroundings like any ordinary patient.
