Cloning is defined as an operation in which the production of an identical genetic cell, tissue and organs is take place. Human cloning is the creation of a genetically identical copy of the human being. And This operation is the result of the substantial development of scientific production in the fields of medicine and genetics.
And this issue remained controversial in most societies, and the most societies rejected it and consider it contrary to the principle of respect for human dignity, because it threatened the essence of the human being represented by his biological. It leads to grant the material nature on the fetus when it was developed in order to destroy it and take its cells as a human spare parts to treat other people.
In United Arab Emirates, it prohibits any form of the cloning operations, and this prohibition stated in article no. 12 of medical liability law, which prohibited in addition to cloning, conduct the researches and medical experiments on human except under his approval and according to the regulations and conditions determined by the implementing regulation, as article 12 provided that:
1. It shall be prohibited to perform human cloning. It shall also be prohibited to conduct research, experiments or applications aiming at human cloning.
2. It shall be prohibited to conduct medial research or experiments on humans unless upon their approval and after obtaining the necessary license from the appropriate body as determined by the implementing regulations and according to the conditions stipulated by such regulations.
cloning has been the result of rapid scientific developments in the medical field and genetics, but the results of conducting cloning operations full of many risks at many levels, such as increasing the racial discrimination between rich and poor people, where the rich countries might be cloning and identify species more than poor countries. The cloning could result in national problems because of people’s fear of mixing races. In addition, the legislation of cloning might open the door to many research and experiments that might be endless, which threatened with great disasters. So the prohibition of cloning, researches and experiments that aimed at the human in the UAE law, was to protect the human dignity, his existences and uniqueness.
